In the second hour of the show, Dr. Hildy welcomes Attorney T. Matthew Phillips, who sued Monsanto in America’s first ever consumer class action lawsuit. The suit alleges that Monsanto is guilty of false advertising by claiming that glyphosate, the active ingredient in Roundup, targets an enzyme only found in plants and not in humans or animals. Monsanto makes this claim to support the contention that glyphosate is harmless to humans.
Given that Monsanto is an enormous corporation, with revenues in the tens of billions annually, why is this lawsuit not bigger news? For six months, this lawsuit has evaded
coverage in the mainstream media. Mr. Phillips has asked the LA Times, New York Times, Huffington Post, CNN, and Reuters to report on the lawsuit, and most enforced a total media blackout.
It is Mr. Phillips goal to make sure that this suit against Monsanto, one of the largest corporations in the US, does not get swept under the rug and that they are held responsible for their actions.

Here’s what it says in the “official” label:
Mode of Action in Plants: The active ingredient in this product inhibits production of an enzyme in plants and microorganisms that is essential to formation of specific amino acids.
In the document “Reregistration …EPA 738-R-93-014, on page
23, it says, “Mechanism of Action: not known at this time, but it
appears to inhibit the aromatic amino acid biosynthesis pathway and may inhibit or repress chlorismate mutase and/or prephenate hydratase.
**Looks like the EPA signed off on “we don’t know.”
Violation of California Business & Professional Section 17500 prohibits businesses from making false or misleading claims concerning goods sold in California.
Under Section 43(a) of the Lanham Act, a claim can be made against a defendant for false or misleading advertising. For a claim against a defendant for false advertising, the following elements are met and the plaintiff must show: (1) defendant made false or misleading statements as to his own products (or another’s); (2) actual deception, or at least a tendency to deceive a substantial portion of the intended audience; (3) deception is material in that it is likely to influence purchasing decisions; (4) the advertised goods travel in interstate commerce; and (5) a likelihood of injury to plaintiff. However, the plaintiff does not have to prove actual injury.

CALIFORNIA! Monsanto being sued for False Advertising. Here’s your chance to get in on the action – class action, that is. A CLASS ACTION LAWSUIT HAS BEEN LAUNCHED AGAINST MONSANTO. A class action lawsuit was filed in Los Angeles County, California, against Monsanto Company. Suit alleges that Monsanto is guilty of false advertising by claiming that glyphosate, the primary ingredient in Roundup weedkiller, is harmless to humans and animals. Compounding scientific evidence is proving that glyphosate is anything but harmless. Recently, both the World Health Organization and the American Cancer Society have declared that glyphosate is a probable human carcinogen.
“You can drink a whole quart of it and it won’t hurt you. It’s not dangerous to humans. No, it’s not.” says Patrick Moore, Industry Lobbyist. Statements like these made by Moore and people such as Kevin Folta, Professor and Chairman of Horticultural Sciences at University of Florida, are irresponsible and endanger public health.
All Monsanto employees should drink a quart of Roundup, especially CEO Hugh Grant and VP & CTO Robert Fraley. Go ahead, make our day. And we hope all 39 million Californians will join the class action lawsuit.

EPA ROUNDUP/CANCER COVERUP EXPOSED: In 1985, the EPA classified glyphosate, the so-called active ingredient in Roundup weedkiller, as a possible carcinogen. Then in 1991, the EPA said, NOPE, it doesn’t cause cancer. There was no new scientific evidence – don’t you wonder what changed their mind? A funny thing happened a couple of weeks ago… The World Health Organization agreed with the EPA’s original assessment and stepped it up a notch. IARC (International Agency for Research on Cancer) scientists thoroughly reviewed the original studies that the EPA cited in 1991 and have reported that glyphosate is a probable human carcinogen. This leads us to ask: Who is the EPA protecting? Monsanto, of course.
